ERC has received three citing complaints arising from the Round 5 Heineken Cup and Amlin Challenge Cup matches with the independent Disciplinary Hearings set for Thursday, 17 January,
Fabrice Estebanez - Citing
ERC has received a Citing Complaint against Racing Metro 92 centre, Fabrice Estebanez (No 12), following the Heineken Cup Pool 1, Round 5 match against Saracens on Saturday, 12 January 2013.
Estebanez is alleged to have struck Saracens player, David Strettle (No 11) with his arm, during the first half of the match at Stade de la Beaujoire.
The complaint was made by Citing Commissioner, Eddie Walsh (Ireland).
Pat Barriscale (Ireland) has been appointed as the independent Judicial Officer for the hearing which will take place in Dublin on Thursday, 17 January.
10.4(a) Punching or striking. A player must not strike an opponent with the fist or arm, including the elbow, shoulder, head or knee(s).
Under the IRB Sanctions for Foul Play, Law 10.4 (a) Striking a player, with a hand, arm or fist carries the following sanction entry points: Low End: 2 weeks; Mid-Range: 5 weeks; Top End: 8+ to 52 weeks.
Ronan O'Gara - Citing
ERC has received a Citing Complaint against Munster Rugby out-half, Ronan O'Gara (No 10), following the Heineken Cup Pool 1, Round 5 match against Edinburgh Rugby on Sunday, 13 January 2013.
O'Gara is alleged to have kicked Edinburgh Rugby player, Sean Cox (No 5), during the second half of the match at Murrayfield.
The complaint was made by Citing Commissioner, Alberto Recaldini, (Italy).
HHJ Jeff Blackett (England) has been appointed as the independent Judicial Officer for the hearing which will take place in Dublin on Thursday, 17 January.
10.4(c) Kicking an opponent. A player must not kick an opponent
Under the IRB Sanctions for Foul Play, Law 10.4 (c) carries the following sanction entry points: Low End: 4 weeks; Mid-Range: 8 weeks; Top End: 12+ to 52 weeks.
Juan Cruz Guillemain - Citing
ERC has received a Citing Complaint against Stade Francais Paris replacement, Juan Cruz Guillemain. (No 19), following the Amlin Challenge Cup Pool 5, Round 5 match against Grenoble on Saturday, 12 January 2013.
Guillermain is alleged to have struck Grenoble player, Fabien Alexandre (No 6) with his head, during the second half of the match at Stade Lesdiguieres.
The complaint was made by Citing Commissioner, Richard McGhee (Scotland).
Pat Barriscale (Ireland) has been appointed as the independent Judicial Officer for the hearing which will take place in Dublin on Thursday, 17 January.
10.4(a) Punching or striking. A player must not strike an opponent with the fist or arm, including the elbow, shoulder, head or knee(s).
Under the IRB Sanctions for Foul Play, Law 10.4 (a) Striking a player with the head carries the following sanction entry points: Low End: 4 weeks; Mid-Range: 10 weeks; Top End: 16+ to 104 weeks.
Notes
i) Citing Commissioner
a) Citing Commissioners are appointed by ERC for all Heineken Cup and all televised Amlin Challenge Cup matches and shall be entitled to cite a Player for any act or acts of Foul Play that in the Citing Commissioner's opinion warranted a red card.
b) For such matches, clubs will not have the power to cite a player but may refer incidents to the Citing Commissioner within 26 hours of the start of the match.
c) The Citing Commissioner will have 50 hours from the start of the match to make a citing. In certain circumstances this deadline can be extended.
d) The ERC Disciplinary Officer, Roger O'Connor may forward the submitted Citing to a Citing Officer to determine whether there are sufficient grounds for the citing to progress.
e) The Disciplinary Officer will then bring a charge against the cited player.
(ii) Disciplinary Hearing
a) The independent Judicial Officer is chosen by the Chairman of the independent Disciplinary Panel, Professor Lorne Crerar.
b) ERC's Disciplinary Officer, Roger O'Connor, presents the case against the player.
c) Both parties to the hearing (ERC and the player) have the right to appeal decisions of the independent Disciplinary Hearing. Appeals must be lodged within 3 working days of receiving the full written decision of the independent Judicial Officer.
d) The full written decision of the independent Judicial Officer will be available on www.ercrugby.com/disciplinenews when the disciplinary process is complete
