ERC is bringing three misconduct complaints following Rounds 1 and 2 of the 2010/11 Heineken Cup and Amlin Challenge Cup competitions.
The misconduct complaints are as follows:
Brendan Venter - Saracens' Director of Rugby
Heineken Cup, Saracens v Leinster, 16 October 2010 (Round 2)
Following an investigation by ERC Disciplinary Officer, Roger O'Connor, into comments made by Brendan Venter to media representatives following the Heineken Cup Pool 2 match between Saracens and Leinster at Wembley Stadium, a misconduct complaint has been lodged against Mr Venter.
The misconduct complaint is that the Saracens Director of Rugby made a number of comments in which he brought into disrepute ERC, the tournament, the match officials and/or the sport of rugby union.
The complaint will be heard by an Independent Disciplinary Committee made up of Jean-Noël Couraud (France) Chairman, Antony Davies (England) and Pat Barriscale (Ireland) at ERC's offices in Dublin on Thursday, 4 November.
Christian Gajan - Bayonne's Director of Rugby
Amlin Challenge Cup, Connacht v Bayonne, 15 October 2010 (Round 2)
Following an investigation by ERC Disciplinary Officer, Roger O'Connor, into comments made by Christian Gajan to media representatives following the Amlin Challenge Cup Pool 1 match between Connacht and Bayonne at The Sportsground, Galway, a misconduct complaint has been lodged against Mr Gajan.
The misconduct complaint is that Bayonne's Director of Rugby made a number of comments to media representatives in which he brought into disrepute ERC, the tournament, the match officials and/or the sport of rugby union.
The complaint will be heard by an Independent Disciplinary Committee made up of Antony Davis (England) Chairman, Jean-Noël Couraud (France) and Pat Barriscale (Ireland) at ERC's offices in Dublin on Thursday, 4 November.
Montpellier- 2010/11 Amlin Challenge Cup
Following an investigation by ERC Disciplinary Officer, Roger O'Connor, into the squad registration made by Montpellier for the 2010/11 Amlin Challenge Cup, a misconduct complaint has been lodged against Montpellier.
The misconduct complaint is that the club, by omitting a number of its international and other players from its Amlin Challenge Cup squad, failed to nominate its strongest possible squad as required by the Tournament Rules.
The complaint will be heard by an Independent Disciplinary Committee made up of Pat Barriscale (Ireland) Chairman, Jean-Noël Couraud (France) and Antony Davis (England) at ERC's offices in Dublin on Thursday, 4 November.

a) The Independent Disciplinary Committees are chosen by the Chairman of the independent Disciplinary Panel, Professor Lorne Crerar.
b) For the first time, a three-person Independent Disciplinary Committee will include one representative of the country of the party against whom the charge has been made.
c) ERC Disciplinary Officer, Roger O'Connor, will present the case against the club / individual
d) Both parties to the hearing (ERC and the club / individual) have the right to appeal decisions of the Independent Disciplinary Committee. Appeals must be lodged within 72 hours of receiving the full written decision from the Chairman of the Independent Disciplinary Committee
e) The full written decision of the Independent Disciplinary Committee will be available on http://www.ercrugby.com/disciplinenews when the disciplinary process is complete
