ERC have received four (4) Citing Complaints following the Round 1 Heineken Cup matches played on 8 / 9 / 10 October 2010.
The Citing Complaints are against:
Jamie Cudmore (number 4) - ASM Clermont Auvergne (v Saracens at Stade Marcel Michelin 09/10/10)
Citing Commissioner: Murray Whyte (Ireland)
Cudmore is alleged to have kicked and/or stamped on Saracens flanker, Jacques Burger, (number 6) in the first half
Law 10.4 (b) 'A player must not stamp or trample on an opponent'.
IRB recommended sanction - Low End: 2 weeks; Mid Range: 5 weeks; Top End: 9+ weeks; Maximum 52 weeks
Law 10.4(c) 'A player must not kick an opponent'.
IRB recommended sanction- Low End: 4 weeks; Mid Range: 8 weeks; Top End: 12+ weeks;, Maximum: 52 weeks
Martyn Williams (number 7) - Cardiff Blues (v Edinburgh at Cardiff City Stadium 09/10/10)
Citing Commissioner: Tony Lanaway (England)
Williams is alleged to have dropped his knee into the face of Chris Paterson (number 15), during the first-half.
Law 10.4(a) 'A player must not strike an opponent with the knee(s)'.
IRB recommended sanction - Low End: 3 weeks; Mid Range: 8 weeks: Top End: 12+ weeks; Maximum: 52 weeks
Sam Tuitupou (number 12) - Munster (v London Irish at Madejski Stadium 09/10/10)
Citing Commissioner: Ray Wilton (Wales)
Tuitupou is alleged to have committed a dangerous tackle on London Irish scrum-half Paul Hodgson (number 9) during the first-half.
Law 10.4(j) 'Lifting a player from the ground and dropping or driving a player into the ground'.
IRB recommended sanction - Low End: 3 weeks; Mid Range: 6 weeks; Top End: 10+ weeks; Maximum: 52 weeks
Jonny Fa'amatuainu (number 19) - Scarlets (v Perpignan at Parc y Scarlets, 09/10/10)
Citing Commissioner: Maurizio Vancini (Italy)
Fa'amatuainu is alleged to have committed a dangerous tackle on the Perpignan wing Adrien Plante (number 14) during the second half.
Law 10.4(e) 'A player must not tackle an opponent late or dangerously'.
IRB recommended sanction - Low End: 2 weeks; Mid Range: 6 weeks; Top End: 10+ weeks; Maximum: 52 weeks
Simon Thomas (Wales) has been appointed as Independent Judicial Officer for the Cudmore and Tuitupou hearings. Antony Davies (England) has been appointed as Independent Judicial Officer for the Williams and Fa'amatuainu hearings.
All four hearings will take place at ERC offices, Huguenot House, 35-38, St Stephen's Green, Dublin 2, Ireland on Wednesday, 13 October 2010.
NOTES
i) Citing Commissioner
a) Citing Commissioners are appointed by ERC for all Heineken Cup and all televised Amlin Challenge Cup matches and shall be entitled to cite a Player for any act or acts of Foul Play that in the Citing Commissioner's opinion warranted a citing.
b) For such matches Clubs will not have the power to cite a player but may refer incidents to the Citing Commissioner within 24 hours of the conclusion of the match.
c) The Citing Commissioner will have 50 hours from the start of the game to make a citing. In exceptional circumstances this deadline can be extended.
d) The ERC Disciplinary Officer, Roger O'Connor may forward the submitted Citing to a Citing Officer to determine whether there are sufficient grounds for the citing to progress.
e) The Disciplinary Officer will then bring a charge against the cited player.
(ii) Independent Disciplinary Hearing
a) Citing hearings will be heard by an independent Judicial Officer as soon as is practicable. Until the hearing a cited player is eligible to play in ERC tournaments
b) The independent Judicial Officer is chosen by the Chairman of the independent Disciplinary Panel, Professor Lorne Crerar.
c) The ERC Disciplinary Officer, Roger O'Connor, presents the case against the player
d) Both parties to the hearing (ERC and the player) have the right to appeal decisions of the independent Disciplinary Hearing. Appeals must be lodged within 72 hours of receiving the full written decision from the Chairman of the independent Disciplinary Committee
e) The full written decision of the independent Judicial Officer will be available on www.ercrugby.com/disciplinenews when the disciplinary process is complete
